These Terms of Service govern your access to and use of Derm, including our website, assessment flows, AI-supported features, paid products, and specialist handoff tools.
Acceptance of Terms
By creating an account, accessing Derm, or using any part of the service, you agree to these Terms of Service ("Terms"). If you do not agree, do not access or use the service.
We may revise these Terms from time to time. If we make material changes, we may provide notice through the product, by email, or by updating the effective date above. Continued use after the revised Terms take effect means you accept them.
Service Description
Derm provides a digital skin-health platform that may include:
- AI-assisted skin analysis based on uploaded images and information you provide.
- Personalized guidance, routines, and treatment suggestions generated through the product experience.
- Access to tele-specialist consultations or referrals where available.
- Progress tracking, reminders, notes, and other care-management tools.
Medical Disclaimer
Derm is a technology platform, not a hospital, emergency service, or substitute for in-person medical care. AI-generated outputs are informational tools designed to support decision-making, not replace professional judgment.
Results produced by the platform are based on the information available to us and may be incomplete, inaccurate, or inappropriate for your situation. You should seek professional medical advice before starting, stopping, or changing treatment.
Where tele-specialist services are available, those services are provided by independent licensed practitioners or care partners. Derm does not practice medicine and is not responsible for the clinical decisions made by third-party providers.
Account Responsibilities
If you create an account, you agree to:
- Provide accurate, current, and complete information.
- Keep your credentials secure and not allow unauthorized people to access your account.
- Notify us promptly if you suspect unauthorized access or misuse.
- Accept responsibility for activity that occurs through your account, except to the extent caused by our failure to maintain reasonable security.
You must be at least 16 years old to create an account unless a different minimum age applies under local law and a parent, guardian, or authorized caregiver is permitted to act on your behalf.
Acceptable Use
You may not use the service to:
- Upload images or information you do not have the right to share, including another person's information without proper authority or consent.
- Submit false, misleading, abusive, or unlawful content.
- Probe, reverse-engineer, scrape, or interfere with the platform, its models, or supporting infrastructure.
- Use the service to harass, harm, exploit, or impersonate another person.
- Circumvent product limitations, security controls, payment requirements, or access restrictions.
Intellectual Property
Derm, including its software, design, branding, content, workflows, and underlying technology, is owned by us or our licensors and protected by intellectual property law.
You keep ownership of content you upload, but you grant us a limited, non-exclusive license to host, process, analyze, store, and display that content as needed to operate, secure, and improve the service in line with our Privacy Policy.
Payments and Subscriptions
Some features may require payment, subscription enrollment, or a one-time purchase. Pricing, billing frequency, and renewal terms will be shown before you complete a transaction.
Unless otherwise stated, fees are non-refundable once earned or consumed. If a subscription renews automatically, you can cancel before the next renewal date to avoid future charges.
Limitation of Liability
To the fullest extent permitted by law, Derm and its affiliates, officers, employees, contractors, and partners are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to the service.
To the fullest extent permitted by law, our aggregate liability for claims relating to the service will not exceed the greater of the amount you paid us in the 12 months before the claim arose or $100.
Disclaimers and Warranties
The service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not guarantee that the service will be uninterrupted, error-free, secure, or suitable for every situation. AI-generated outputs should be treated as informational guidance, not definitive medical conclusions.
Termination
You may stop using Derm at any time. We may suspend, restrict, or terminate access if we reasonably believe you have violated these Terms, created risk for other users, failed to pay amounts due, or used the service in a way that could harm the platform or others.
When access ends, your right to use the service stops immediately, but provisions that by their nature should survive termination will continue to apply. Data handling after closure is described in our Privacy Policy.
Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.
Any dispute arising out of or relating to these Terms or the service will be resolved through binding arbitration administered under the rules of the American Arbitration Association, unless applicable law in your jurisdiction does not allow arbitration or requires another forum.
